DEFINITIONS
In this Disclaimer Policy (“Policy”), unless the context otherwise requires:
(a) “Company”, “we”, “our”, or “us” refers to MindStocs, a sole proprietorship entity operating from Sindhudurg, Maharashtra, India, including its platforms, communication channels, and authorised representatives.
(b) “User”, “Subscriber”, “Client”, “you”, or “your” refers to any individual or entity who accesses, purchases, subscribes to, or utilises any Service offered by the Company.
(c) “Services” refers to all software, dashboards, indicators, automation tools, APIs, VPS hosting, educational modules, and any digital utilities provided by the Company.
(d) “Platform” refers to the official website www.mindstocs.com, web-based dashboards, member portals, or any authorised digital interface through which Services are delivered.
(e) “Content” refers to all written, visual, audio, video, analytical, or data-based material made available by the Company.
(f) “Third-Party Integrations” refers to any external platform, broker, API bridge, VPS provider, payment gateway, or software service connected or used by the User.
This Policy forms an integral and inseparable component of the Company’s Terms & Conditions, Privacy Policy, Refund & Cancellation Policy, Shipping & Exchange Policy, and Contact & Communication Policy.
1. NATURE & PURPOSE OF SERVICES
MindStocs provides software, dashboards, automation tools, APIs, VPS hosting, and educational utilities. All Services are strictly technological in nature and do not constitute financial, investment, advisory, legal, tax, or brokerage services.
The Company does not provide trading signals, trade execution, portfolio advice, market predictions, or profit-based guidance.
2. NO REGULATED FINANCIAL ROLE
MindStocs is not registered or licensed with SEBI, RBI, IRDAI, or any statutory financial authority in India or abroad. The Company does not operate as:
(a) an investment advisor or research analyst,
(b) a stockbroker or exchange intermediary,
(c) a portfolio manager or collective investment manager,
(d) a payment, deposit, or financial product issuer.
All Services are purely software and technology utilities.
3. NO FINANCIAL ADVICE OR RETURNS
(a) The Company does not provide buy/sell suggestions, trade recommendations, or investment guidance.
(b) The Company does not guarantee profit, capital appreciation, fixed returns, or any financial outcome.
(c) The User remains solely responsible for any financial or operational decisions made using external platforms.
4. USER RESPONSIBILITY
(a) The User is solely responsible for how they use the software, tools, or API integrations.
(b) The Company is not responsible for User activity, financial exposure, or third-party platform actions.
(c) Any decision taken by the User is based on their own discretion, risk capacity, and independent evaluation.
5. LIMITATION OF LIABILITY
The Company shall not be liable for:
(a) financial or commercial losses of any kind,
(b) downtime, execution delay, or performance issues caused by third-party platforms,
(c) errors arising from User-side configuration, misuse, or unauthorised modification,
(d) broker, API, VPS, network, or market-related disruptions not controlled by the Company.
6. NO PARTNERSHIP OR FIDUCIARY RELATIONSHIP
Use of the Platform does not create a partnership, agency, trustee, advisory, joint venture, or fiduciary relationship between the User and the Company.
7. THIRD-PARTY DEPENDENCIES
Any integration with brokers, VPS systems, APIs, or external platforms is solely at the User’s discretion. The Company does not endorse, control, or guarantee performance of any third-party service.
8. EDUCATIONAL CONTENT DISCLAIMER
Any tutorials, walkthroughs, or learning content are informational only and do not replace certified professional, legal, or financial advice.
9. REGULATORY COOPERATION
The Company will comply with lawful written directions issued by competent authorities under applicable Indian law.
10. GOVERNING LAW & JURISDICTION
This Policy is governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of the courts at Sindhudurg, Maharashtra, India.
11. USER ACKNOWLEDGEMENT
By accessing any Service, the User confirms that they:
(a) have read and understood this Disclaimer,
(b) accept full responsibility for their actions,
(c) do not rely on any verbal, informal, or third-party claims.
